About these terms

These Terms of Service are an agreement between you and Beach Break Apps, St. Petersburg, Florida (“Beach Break Apps,” “we,” or “us”) for your use of Paintfolio. By creating an account or using Paintfolio, you agree to these terms and our Privacy Policy.

What Paintfolio does

Paintfolio helps painting businesses manage customers, properties, estimates, proposals, jobs, schedules, crew, labor, materials, photos, forms, payment records, calendar feeds, and related business information. Some features may be unavailable, changed, or offered separately.

You are responsible for the accuracy of estimates, prices, tax settings, contracts, schedules, payment instructions, and other information you provide or send through the service. Paintfolio is a business tool, not legal, tax, accounting, or insurance advice.

Accounts and acceptable use

You must provide accurate account information, keep your sign-in credentials secure, and be authorized to act for the business you add. You are responsible for activity by your team members and for assigning appropriate access roles.

You may not use Paintfolio to:

• break the law, infringe another person’s rights, or send unlawful or deceptive material;
• upload malicious code or interfere with the service or another account;
• access data you are not authorized to access;
• send spam or misuse proposal, follow-up, or payment links; or
• copy, resell, reverse engineer, or abuse the service except where law permits.

Your content

You keep ownership of the business records, customer information, photos, logos, documents, paint specifications, and other content you upload or enter. You give us a limited permission to host, process, display, back up, and transmit that content only as needed to operate, secure, support, and improve Paintfolio.

You confirm that you have the rights and permissions needed to provide the content, including customer and employee information and job-site photos. You are responsible for complying with privacy, employment, recording, and marketing laws that apply to your business.

Subscriptions, renewals, and refunds

Paintfolio currently shows plan pricing, but its own online subscription checkout is not yet active. If paid Paintfolio subscriptions become available, the price and billing period will be shown before purchase. Unless stated otherwise at checkout, monthly or annual subscriptions renew automatically until canceled. Cancellation stops future renewals and does not erase your account immediately. Refunds are available by request at our discretion, except where law requires otherwise.

Customer payments

Painting companies may record offline payments and, when enabled, connect their own Stripe account to accept card or bank payments from customers. Stripe processes those online payments directly for the painting company. Beach Break Apps never stores full card or bank-account numbers. Payment disputes, refunds, taxes, fees, and customer obligations remain between the painting company, its customer, and Stripe as applicable.

Suspension and termination

You may stop using Paintfolio at any time and may request account deletion. We may suspend or terminate access when reasonably necessary for security, nonpayment, legal compliance, harmful conduct, or a serious or repeated breach of these terms. Where practical, we will provide notice and an opportunity to resolve the issue.

Service availability and warranties

We work to keep Paintfolio useful and available, but the service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and noninfringement. We do not guarantee uninterrupted service, error-free calculations, delivery of every email, or availability of third-party services.

Limitation of liability

To the fullest extent permitted by law, Beach Break Apps will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, customers, or business opportunities arising from Paintfolio. Our total liability for a claim will not exceed the amount you paid us for Paintfolio during the 12 months before the event giving rise to the claim, or $100 if you paid nothing. Some laws may not allow every limitation, so those limitations apply only as permitted.

Changes and governing law

We may update these terms as Paintfolio or the law changes. We will post the updated date and provide additional notice when required. Continued use after an update means you accept the revised terms. Florida law governs these terms, without regard to conflict-of-law rules. Courts located in Pinellas County, Florida will have exclusive jurisdiction where the law permits.
